In an opinion piece published in the Los Angeles Times on January 15, Vice Dean Barry Friedman argued that the U.S. Supreme Court was wrong to bar video coverage of California’s Proposition 8 trial on same-sex marriage. “Like the Scopes ‘monkey trial’ with which it is sometimes compared,” Friedman wrote, the Proposition 8 trial  “is not a legal case in the strict sense. It is a morality play aimed at all of us, speaking in a sense for all of us, and we should get to hear it."

Friedman, who is also Jacob D. Fuchsberg Professor of Law, is the author of The Will of the People:  How Public Opinion Has Influenced the Supreme Court and Shaped the Meaning of the Constitution, published by Farrar, Straus and Giroux in October.
