The Zimroth Center's annual conference will focus on the Supreme Court's decision in United States v. Salerno, which led to an explosion in pretrial detention at both the state and federal levels. Although pretrial detention seems commonplace today, it is a recent phenomenon that is at odds with much of American history. The conference will detail the historical right to bail at the Founding and the steady erosion of this right beginning in the 1960s, culminating in the 1984 Bail Reform Act and the Supreme Court's decision in United States v. Salerno, and will discuss legal and policy strategies designed to counter the ill effects of Salerno. Panelists include:
