Property, Investment, and International Law from 1957 to Now: A Conversation with Nicolas M. Perrone

Professors Perrone and Larkin will discuss the concepts of property and investment in international investment law, discussing theoretical and historical concerns about how the investment regime would interact with national sovereignty and empower multinational corporations. The talk will draw on Professor Perrone's forthcoming co-authored piece in EJIL on the drafting of the 1967 OECD Draft Convention on the Protection of Foreign Property and on Professor Larkin's forthcoming piece in the Harvard International Law Journal, From Business Plans to International Rights, which highlights how investment treaties have let businesses define the scope of their protection in ways that conflict with and constrain national law.
