The entanglement of capitalist exploitation and the authoritarian regression of political systems becomes more evident every day. Law entrenches capitalism, which, in turn, notoriously reconstitutes itself after attempts at constraint. How, then, is it possible to transform the law that encodes capitalist power? Professor Pistor suggests that the starting point for such transformation is to define normative foundations drawing on the idea of human capabilities, and to utilize avenues that are scattered across existing rules and procedures. The European Union, caught amid the recent expansion of autocratic forces, provides a particularly urgent example of the need for transformation. As argued in a recent op-ed co-authored by Professor Katharina Pistor, European integration requires a bottom-up transformation of politics and law to ensure concrete conditions for the exercise of democratic ways of life.
