Increasingly complex requirements are reshaping how non-profit organizations recruit and onboard talent across jurisdictions. This discussion examines ban-the-box laws, salary history bans, and pay transparency obligations, with a focus on maintaining consistent policies for national nonprofits amid varied state rules. It also explores background check requirements under the Fair Credit Reporting Act, including consent and standalone disclosure forms, adverse action procedures, and state-specific considerations, as well as variations for certain organizations. The session concludes with best practices for offer letters, including conditional offers, contingencies, and at-will acknowledgments.
