Sixteen AGs Protested Petition that Requested FERC Assert Jurisdiction Over Net Metering

Massachusetts Attorney General Maura Healey led a coalition of 16 attorneys general in filing a protest urging the Federal Energy Regulatory Commission (FERC) to deny a petition that requested the commission assert federal jurisdiction over net metering. If approved, the petition would upend existing state-based net metering programs and dramatically slow the growth of rooftop solar and other kinds of distributed electricity generation. In their protest, the AGs detailed the extensive legal and practical problems with the petition, and emphasized that even after setting aside its “substantial procedural flaws,” the petition “provides no credible legal argument and cites no facts allowing the Commission to articulate a detailed justification for the policy change, as required by the [Administrative Procedure Act].”
