New Jersey AG Urged Supreme Court to Deny PennEast’s Petition for Cert in Litigation Over Taking of State Land

New Jersey Attorney General Gurbir Grewal filed a brief urging the U.S. Supreme Court to deny pipeline developer PennEast’s petition for cert in litigation over the exercise of eminent domain over state-owned lands. The brief emphasized that “[n]one of the traditional criteria support” granting PennEast’s petition, and that the Third Circuit decision at issue “reflects core sovereign immunity principles and basic rules of statutory interpretation,” and “does not split with—or even create tension with—the decisions of any other circuit.”
