Massachusetts AG Secured Penalties against Solar Developer over Damage to Wetlands and Waterways

Massachusetts Attorney General Maura Healey secured a settlement with solar developer Dynamic Energy Solutions, LLC, over Clean Water Act violations involving “excessive sediment discharges to the West Branch Mill River and Rogers Brook and their associated tributaries and wetlands resource areas.” Under the terms of the settlement, the company was required to pay a total of $1.14 million in costs and penalties, including $530,000 in restoration costs, $215,000 to fund the acquisition of nearby lands to be placed into a conservation trust, and $100,000 in penalties to the state. The $1.14 million total included placing a 24-acre parcel of land valued at $210,000 into conservation.
