Maryland AG Moved to Protect State Lands in Litigation Over Natural Gas Pipeline

Maryland Attorney General Brian Frosh filed a motion to dismiss a condemnation action that would authorize Columbia Gas Transmission, LLC to construct a segment of a natural gas pipeline on a tract of protected state land. In a memorandum in support of the motion, Attorney General Frosh asserted that because states are immune from suit brought by private citizens under the Eleventh Amendment, Columbia Gas cannot exercise eminent domain against the state of Maryland.
