Five AGs Filed Amicus Brief in Support of FERC Orders on Energy Storage Resources

Massachusetts Attorney General Maura Healey and California Attorney General Xavier Becerra led a coalition of five attorneys general in filing an amicus brief urging the U.S. Court of Appeals for the D.C. Circuit to uphold Federal Energy Regulatory Commission (FERC) orders that facilitate the participation of energy storage resources in wholesale electricity markets. The brief emphasizes that FERC’s orders comport with the commission’s authority under the Federal Power Act, and that storage resources are “an essential complement to States’ efforts to promote and sustain a clean energy power system” because they are compact, scalable, relatively easy to deploy, and help make the power system more flexible and responsive.
